Terms of Service

Draft for review. These terms should be reviewed by an attorney familiar with counseling practice and your state’s licensing rules before you rely on them.

These Terms of Service (“Terms”) govern your use of the Vine & Branch client portal (the “Portal”), operated by Vine & Branch Advisory & Counsel Group, LLC (“Vine & Branch,” “we,” “us”). By creating an account or using the Portal, you agree to these Terms.

Not for emergencies

The Portal is not monitored around the clock and is not a crisis service. If you are experiencing a medical or mental-health emergency, call 911, go to your nearest emergency room, or call or text 988 (Suicide & Crisis Lifeline). Do not use the Portal to communicate urgent or time-sensitive needs.

What the Portal is

The Portal is a tool for scheduling sessions, completing intake forms, and exchanging secure messages with a counselor. It is not itself counseling, medical advice, or a diagnosis. The counseling relationship, if any, is governed by the separate informed-consent and practice-policy documents you receive from your counselor, which control if they conflict with these Terms.

Eligibility & accounts

You must be 18 or older to create an account, or the parent/legal guardian creating an account on behalf of a minor. You are responsible for keeping your password confidential and for activity under your account. Tell us promptly at info@vineandbranch.group if you suspect unauthorized access.

Acceptable use

Use the Portal only for its intended purpose. Do not attempt to access other users’ data, disrupt the service, upload malicious content, or use the Portal to harass or harm others.

Communications

By creating an account you agree to receive service-related email from us. If you provide a mobile number you also agree to receive text notifications as described in our SMS notice and Privacy Policy; providing a mobile number is optional and you can opt out at any time by replying STOP.

Confidentiality

Messages and intake information you submit are treated as confidential and shared only with your assigned counselor and administrative staff who need access to support your care, except as required or permitted by law (including mandatory reporting of abuse or imminent risk of harm). No warranty; limitation of liability

The Portal is provided “as is.” We do not warrant that it will be uninterrupted or error-free, and we are not responsible for delayed or undelivered messages caused by third-party carriers or service providers. To the fullest extent permitted by law, our aggregate liability arising from your use of the Portal is limited to the amount you paid us, if any, to use the Portal.

Termination

You may stop using the Portal at any time and request account deletion by contacting us. We may suspend or terminate access for violation of these Terms or to protect the service or other users.

Changes

We may update these Terms; material changes will be posted here with a new “last updated” date. Continued use after changes means you accept them.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules.
